Professional Terms of Service

These additional terms apply to healthcare professionals (nutritionists, fitness trainers, doctors, therapists, and other practitioners) using Swasth to provide services to clients.
1. Scope and Acceptance
These Professional Terms of Service ("Professional Terms") supplement our general Terms of Service. By creating a Professional Profile on Swasth, you agree to both the general Terms and these Professional Terms.
2. Professional Types
Swasth supports the following professional categories:
2.1 Fitness & Wellness
- Nutritionists and Dieticians
- Gym Trainers and Yoga Trainers
- Chefs and Food Scientists
2.2 Mental Health
- Therapists and Counselors
- Psychologists and Psychiatrists
- Clinical Social Workers
2.3 Medical Doctors
- General Physicians, Pediatricians
- Cardiologists, Dermatologists, Orthopedics
- Gynecologists and other specialists
2.4 Alternative Medicine
- Ayurvedic Practitioners
- Homeopathic Practitioners
3. Eligibility and Verification
3.1 Credential Requirements
To create a Professional Profile, you must:
- Hold valid, current credentials for your profession
- Be licensed/registered to practice in your jurisdiction
- Maintain professional liability insurance (where applicable)
- Comply with all applicable professional regulations
3.2 Verification Process
Your profile will be subject to verification:
- UNVERIFIED: Initial profile state
- PENDING_REVIEW: Documents submitted for review
- VERIFIED: Credentials confirmed by our team
- REJECTED: Verification unsuccessful
Only verified professionals can invite clients and access certain features. We reserve the right to request additional documentation at any time.
3.3 Ongoing Compliance
You must:
- Keep credentials current and update your profile accordingly
- Notify us immediately if credentials are suspended or revoked
- Comply with continuing education requirements
- Maintain good standing with relevant regulatory bodies
4. Professional-Client Relationships
4.1 Independent Practice
You acknowledge that you operate as an independent professional. Laxhar Tech is not your employer, partner, or agent. You are solely responsible for:
- The quality and appropriateness of your services
- Clinical decisions and recommendations
- Compliance with professional standards of care
- Maintaining appropriate professional boundaries
4.2 Client Relationships
When establishing client relationships through Swasth:
- Use the invitation system to formally establish relationships
- Respect client privacy settings and data sharing preferences
- Maintain professional conduct in all communications
- Use encrypted messaging for sensitive communications
4.3 Scope of Practice
You must operate within your licensed scope of practice. Do not provide services or advice outside your professional qualifications.
5. Data Access and Privacy
5.1 Client Data Access
You may access client health data only:
- When the client has granted explicit permission
- For data categories the client has chosen to share
- For purposes related to your professional services
- While maintaining active relationship status
5.2 Data Protection Obligations
As a data processor, you agree to:
- Process client data only for authorized purposes
- Implement appropriate security measures
- Not share client data with unauthorized third parties
- Notify us immediately of any data breaches
- Comply with applicable data protection laws (DPDPA, etc.)
5.3 Professional Notes
Notes you create about clients are your responsibility. Ensure they comply with professional record-keeping standards and applicable regulations.
6. Consultations and Appointments
6.1 Booking Management
You are responsible for:
- Setting accurate availability
- Confirming or declining bookings promptly
- Conducting scheduled consultations professionally
- Providing reasonable notice for cancellations
6.2 Telemedicine Compliance
For video/phone consultations, ensure compliance with telemedicine regulations in your jurisdiction and the client's location.
7. Payments and Fees
7.1 Payment Requests
You may use the payment request feature to invoice clients. You are responsible for:
- Setting fair and transparent fees
- Providing clear invoices with itemized services
- Complying with tax and billing regulations
- Handling payment disputes directly with clients
7.2 Platform Fees
Swasth does not currently charge platform fees for professional services. This may change with prior notice.
7.3 No Payment Processing
Swasth does not process payments. Payment requests are informational only. You and your clients are responsible for payment arrangements.
8. Assignments and Prescriptions
8.1 Meal and Workout Plans
When assigning plans to clients:
- Ensure plans are appropriate for the client's health status
- Consider disclosed allergies, conditions, and preferences
- Monitor adherence and adjust as needed
- Document rationale for professional recommendations
8.2 Medical Prescriptions
Only licensed medical professionals may issue medical prescriptions. Prescription features must comply with applicable pharmaceutical regulations.
9. Content and Communications
9.1 Professional Content
Content you post (articles, recipes, advice) must be:
- Accurate and evidence-based
- Within your professional expertise
- Compliant with advertising regulations for healthcare
- Not misleading or making unsubstantiated claims
9.2 Client Communications
Messages to clients should be:
- Professional and respectful
- Relevant to the professional relationship
- Not harassing, threatening, or inappropriate
Use encrypted messaging for sensitive health information.
10. Prohibited Conduct
Professionals must not:
- Provide services outside licensed scope of practice
- Misrepresent credentials or qualifications
- Engage in romantic or sexual relationships with clients
- Exploit client data for unauthorized purposes
- Make false claims about treatment outcomes
- Violate client confidentiality
- Discriminate against clients
- Engage in fraudulent billing practices
11. Liability and Insurance
11.1 Professional Liability
You are solely liable for your professional services. Laxhar Tech is not liable for any claims arising from your professional practice.
11.2 Insurance Requirements
We strongly recommend maintaining professional liability insurance covering services provided through the platform.
11.3 Indemnification
You agree to indemnify Laxhar Tech against any claims, damages, or losses arising from your professional services, violations of these terms, or professional misconduct.
12. Termination
12.1 Voluntary Termination
You may deactivate your Professional Profile at any time. Existing client relationships should be properly concluded.
12.2 Termination by Us
We may suspend or terminate your Professional Profile for:
- Violation of these Professional Terms
- Loss or suspension of professional credentials
- Professional misconduct or ethical violations
- Complaints from clients
- Legal or regulatory requirements
12.3 Effect of Termination
Upon termination:
- Active client relationships will be ended
- Access to client data will be revoked
- Professional notes may be retained per legal requirements
- Outstanding payment requests remain your responsibility
13. Reporting and Complaints
Clients may report concerns about professional conduct. We will investigate reports and may take action including profile suspension or termination.
14. Changes to Terms
We may modify these Professional Terms with 30 days notice. Continued use of professional features constitutes acceptance.
