Emergency Services Disclaimer

Do NOT rely solely on Swasth for emergency medical situations. The ambulance booking feature is a convenience service and should not replace calling emergency services directly.

1. Nature of Emergency Services

Swasth provides features to help users access emergency services, including:

  • Ambulance booking interface
  • Medical facility finder
  • Emergency contact management
  • First aid guides
  • Crisis helpline information

These features are informational and convenience tools. LaxharTech does NOT directly provide emergency medical services.

2. Ambulance Booking Service

2.1 Who Provides the Ambulance

Ambulances listed on Swasth are owned and operated by independent businesses registered on the platform ("Ambulance Businesses"). The drivers and medical staff who attend to a booking are personnel of those businesses. To list, an Ambulance Business and its assigned drivers/staff must complete identity and document verification (KYC), and the business must provide its vehicle documents.

LaxharTech (operator of Swasth):

  • Operates the booking, dispatch, routing and payment technology only
  • Does NOT own or operate ambulances
  • Does NOT employ ambulance drivers, medical staff, or the Ambulance Businesses
  • Does NOT provide medical care, transport, or treatment
  • Does NOT guarantee ambulance availability, response times, or fitness for your specific emergency
  • Performs verification checks but does NOT warrant the quality, conduct, equipment, or clinical competence of any Ambulance Business, driver, or staff member

Each Ambulance Business is solely responsible for the ambulance service it provides, including the vehicle, equipment, staffing, clinical care, and conduct of its drivers and staff.

2.2 Automated Dispatch

When you request an ambulance, Swasth's automated dispatch system selects and ranks candidate ambulances using estimated travel time and distance, and offers the booking to a candidate on your behalf. If an offer is declined or times out, the system may automatically re-offer the booking to the next candidate. You acknowledge that:

  • Dispatch and ranking are automated and based on estimates, not guarantees
  • An offer may be declined, and a matching ambulance may not always be found
  • Neither you nor the Ambulance Business selects the order of candidates manually
  • Assignment, arrival, and equipment match are NOT guaranteed

2.3 Fares and Estimates

Any fare and estimated time of arrival (ETA) shown before or during a booking are estimates generated from routing data and the Ambulance Business's pricing configuration. They are not guaranteed. The final amount payable (which may include a collective or itemised bill) is set by the Ambulance Business and may differ from the estimate based on the actual route, time, distance, and services rendered.

2.4 Payments

Ambulance payments are handled in one of two modes, depending on the Ambulance Business:

  • Platform-processed (commission) mode: you pay through our integrated payment gateway (PayGate). The platform facilitates the payment and deducts the applicable platform service fee and taxes before settlement to the Ambulance Business.
  • Direct mode: you pay the Ambulance Business directly (e.g. UPI, QR, or bank transfer) and submit proof of payment; only the Ambulance Business can confirm receipt. LaxharTech is not a party to, and does not hold or transfer, funds in direct mode.

2.5 Live Location Tracking

To fulfil a booking, your pickup and drop-off locations and the ambulance's real-time GPS location are shared, while the booking is active, among you, the assigned Ambulance Business, and its assigned driver/staff. Tracking stops when the booking ends. See our Privacy Policy and Consent Management page for how this location data is used, shared, and retained.

2.6 In-App Chat and Ratings

You may communicate with the Ambulance Business through the in-app encrypted chat, and you may rate and review a trip after completion. Ratings and reviews must be honest and are subject to our Acceptable Use Policy.

2.7 Service Limitations

The ambulance booking feature:

  • Depends on internet connectivity
  • Depends on GPS/location accuracy
  • Depends on Ambulance Business availability in your area
  • May experience delays or technical issues
  • Is NOT a substitute for calling 112 or 108

2.8 No Guarantee of Service

We cannot guarantee that an ambulance will be dispatched, arrive within a specific time, or be equipped for your specific emergency. Availability depends on independent Ambulance Businesses.

3. Location Services

3.1 GPS Accuracy

Location information used for ambulance booking may be inaccurate due to:

  • GPS signal quality
  • Device limitations
  • Indoor positioning challenges
  • Network conditions

Always verify and communicate your exact location to emergency services verbally.

3.2 Address Information

Ensure you provide accurate address information including landmarks. Do not rely solely on GPS coordinates for emergency location.

4. Medical Facility Finder

4.1 Information Accuracy

Medical facility information (hospitals, clinics, pharmacies) is provided for convenience. We do NOT guarantee:

  • Accuracy of facility information
  • Current operating hours
  • Service availability
  • Quality of care
  • Insurance acceptance

4.2 User Verification

Always call ahead to verify facility information, especially for emergency services, before traveling.

5. First Aid Guides

5.1 Informational Only

First aid guides provided on Swasth are for general informational purposes only. They:

  • Are NOT a substitute for professional medical training
  • May not cover all emergency situations
  • Should not replace professional first aid certification
  • May not be appropriate for your specific situation

5.2 Seek Professional Help

In any medical emergency, seek professional medical help immediately. Use first aid guides only as temporary measures until professional help arrives.

6. Crisis Helplines

We provide crisis helpline information (mental health, suicide prevention, domestic violence) for user convenience. We:

  • Do NOT operate these helplines
  • Cannot guarantee helpline availability
  • Are NOT responsible for helpline services

If you are in crisis, please reach out to these resources or emergency services directly.

7. User Responsibilities

When using emergency features, you agree to:

  • Call 112 or 108 directly for life-threatening emergencies
  • Provide accurate location and contact information
  • Verify facility information before traveling
  • Not rely solely on the app during emergencies
  • Understand limitations of technology-based services

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LAXHARTECH SHALL NOT BE LIABLE FOR:

  • Delays in ambulance dispatch or arrival
  • Unavailability of ambulance services
  • Quality of care provided by ambulance staff
  • Inaccurate location or facility information
  • Inaccuracy, delay, or interruption of live-location tracking or ETA estimates
  • Differences between estimated fares and the final amount billed by an Ambulance Business
  • Payment processing, payment disputes, or settlement (whether via PayGate or direct payment)
  • Technical failures during emergencies
  • Any injury, death, or damages resulting from emergency service use
  • Actions or inactions of independent Ambulance Businesses, drivers, or staff

9. Indemnification

You agree to indemnify LaxharTech against any claims arising from your use of emergency features or reliance on emergency-related information.
